Why has Council prepared these draft policies? 

    The draft policies have been developed to provide a clear and consistent framework for managing Council leases, licences, and subsidies for hire of facilities. Council is seeking feedback to ensure the policies are practical and fair and reflect community expectations. 

    Who will be impacted by these Policies?

    Lease and Licence Policy 

    • Any person or organisation that has a lease or licence for a Council facility in overholding, or is occupying a Council facility without a current written lease or licence, will be impacted.   

    • Any person or organisation that has a current lease or licence for a Council facility will be impacted only when their current agreement expires and a new agreement is being negotiated.  

    • Any person or organisation that is seeking a new agreement for use of an unoccupied building. 

    Community and Sports Facilities Subsidies Policy 

    • Any person or organisation that uses the Bookable system to hire a facility within Mitchell Shire is impacted by this policy.  This includes seasonal hire. 

    Funding and Services Agreements (FASA) 

    • If your organisation is under a FASA, or has an agreement for use of a Council facility with a committee of management that is under a FASA, you are not impacted by these policies. 

    When would the policies take effect?

    Both policies will take effect following the consultation period, review of feedback received, amendments if required, further consideration and formal adoption of the policies by Council. This is scheduled for May 2026.   

    How will these policies impact how much my organisation pays?

    Lease and Licence Policy 

    • The policy provides a framework that influences the cost recovery expectation of lease and licence agreements:  

      • Private / Commercial  
      •  Not For Profit / Government 
      • Volunteer based  
    • Lease and licence agreements may be negotiated outside of the framework on a case by case basis where a specific service need is applicable. 

    Community and Sports Facilities Subsidies Policy 

    • This policy does not set fees for use of facilities. Fees for use of Council facilities are set by Council as part of the annual budget process.   

    • Council’s 2026/27 draft fees and charges will be available for comment in April or May 2026. Please look out for advertising and visit https://engagingmitchellshire.com/ to provide feedback.   

    • This policy impacts the amount paid by hirers of Council facilities in two ways  

    • Through the categorisation of users for the eligibility of subsidies as follows:  
      • Private / Commercial  

      • Not For Profit / Government  

      • Volunteer based  

      • Through the availability of additional subsidies for eligible hirers:  

      • Regular hirers  

      • Establishment support for newly established groups 

      • Junior sports associations / junior clubs 

      • Sports associations and sports clubs that provide teams for multiple genders in recognised competitions

      • State sporting association auspiced junior programs.
