What is a Section 26 On Leash Order?
Section 26 of the Domestic Animals Act 1994 allows Victorian Councils to prohibit dogs from certain public places within their municipality, or to require dogs to be on leash unless in a designated off-leash area named by the Shire.
Why is the On-leash order being considered?
Pets form an important part of vibrant communities, and the mental, social and health benefits that they bring cannot be underestimated.
We understand that some dogs are very well trained, however there are increasing instances of off leash dogs rushing up to other dogs, children playing, or adults walking along the street. There are also increasing reports of off leash dogs chasing livestock and wildlife.
Council needs to balance the needs of pet owners and non-pet owners to ensure that pet ownership within Mitchell Shire does not have significant negative impacts for the wider community or for the environment.
Dogs that are not on leash pose a risk to community members as well as motorists and other user groups.
Part of our community vision is to have parks and playgrounds that are inviting and utilised, and for community members from all walks of life to feel safe and secure throughout the municipality. Many members of our community are fearful of dogs, and the presence of off leash dogs impacts their ability to utilise public spaces.
Will I still be able to exercise my dog off-leash?
Yes, you will be able to exercise your dog off-leash in designated off-leash areas, or in fenced dog parks.
Your dog will still need to be under effective control, and you will need to make sure that your dog does not cause a nuisance to others.
